In the height of the COVID-19 panic, the Secretary of Health and Human Services decided to waive many of the restrictions found in the Stark Law (Physician Self-Referral Law). The goal behind the waiver was to increase access to healthcare for those who needed it most because of COVID-19.
However, as the federal government gets ready to end its declaration of a federal state of emergency, the regulations under the Stark Law will likely be going back into effect. Healthcare professionals should be aware of this and they should consider the financial and reporting impact of this change.
